1. Acceptance of Terms

By accessing PunterSwarm ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Nature of the Service

PunterSwarm is an analytical tool. All forecasts, swarm outputs, and Kelly-sizing recommendations are for informational purposes only. Nothing on this platform constitutes financial advice, betting advice, or a solicitation to place wagers.

3. No Guarantee of Accuracy

Forecasts are probabilistic estimates derived from AI models. Past calibration does not guarantee future accuracy. You accept full responsibility for any decisions made using the Service.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Prohibited Use

You may not: (a) use the Service in any jurisdiction where prediction markets are illegal; (b) resell or redistribute swarm outputs without written consent; (c) use automated scripts to scrape the platform at rates exceeding 60 requests/minute.

6. Intellectual Property

The PunterSwarm platform, including the swarm architecture, analyst archetypes, and UI, is proprietary intellectual property. You are granted a limited, non-exclusive licence to use the Service for personal, non-commercial purposes.

7. Limitation of Liability

To the maximum extent permitted by law, PunterSwarm shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.

8. Governing Law

These Terms are governed by the laws of England and Wales.

1. Data We Collect

— Usage data: screens visited, queries submitted, swarm runs initiated.

— Portfolio data: shadow trades and watchlist items you explicitly create.

— We do not collect payment card details (handled by Stripe).

2. How We Use Your Data

— To provide and improve the Service.

— To compute aggregate calibration metrics (Brier scores).

— We do not sell your data to third parties.

3. Data Storage

All user data is stored in an isolated PostgreSQL instance. Shadow trades and watchlist items are keyed to your user ID and are not visible to other users.

4. Data Retention

Portfolio and watchlist data is retained until you delete it or close your account. Server logs are purged after 30 days.

5. Cookies

We use a single session cookie to maintain your authenticated session. No tracking or advertising cookies are used.

6. Third-Party Services

We integrate with Polymarket and Kalshi APIs to fetch market data. Their respective privacy policies apply to data they collect.

7. Your Rights (GDPR)

You have the right to access, correct, or delete your personal data. To exercise these rights, email privacy@punterswarm.io.

1. Free Trial

All plans include a 7-day free trial. No payment is taken during the trial period. You may cancel at any time before the trial ends without charge.

2. Monthly Subscriptions

Monthly subscriptions are billed on the same date each month. Cancellations take effect at the end of the current billing period. We do not offer pro-rata refunds for partial months.

3. Annual Subscriptions

Annual subscribers who cancel within 14 days of their most recent annual charge are entitled to a full refund. After 14 days, no refund is issued but the subscription remains active until the annual period ends.

4. Service Outages

If the Service experiences an outage exceeding 24 continuous hours in a calendar month, affected subscribers may request a pro-rata credit applied to their next billing cycle.

5. How to Request a Refund

Email refunds@punterswarm.io with your account email and the reason for your request. We respond within 2 business days.

6. Chargebacks

Initiating a chargeback without first contacting us may result in immediate account suspension. We encourage you to reach out — we want to resolve issues fairly.
